Article 159 of the Constitution mandates the Judiciary to promote Alternative Dispute Resolution (ADR) in the administration of Justice. In line with its Transformation Framework, the Judiciary has embraced Mediation as an Alternative Dispute Resolution as an avenue for delivering expeditious and people driven Justice. Mediation is an informal and non-adversarial process where an impartial mediator encourages and facilitates resolution of a dispute between two or more Parties.

 

Consequently, almost all the cases related to business, civil, family, land, employment among others filed at the Courts are now being referred for mediation with the speed and success rate being reported by the Judiciary as very positive.

Local and international business ventures and organizations too have embraced mediation and majority of them have been subjecting their disputes to mediation as mediation is faster, less expensive, parties have control over the process and always promotes relationships.

 

Increasingly corporations and many organizations have also resorted to training their human resource personnel, heads of departments and other key staff members in mediation as this resolves conflicts within the work place and increases understanding among employees thus boosting productivity. The training thus becomes beneficial at the workplace and positively impacts the organizations who have employees who are trained mediators. The trained mediators also join a pool of others who can handle mediation assignments locally and internationally.

 

FWC in conjunction who its academic wing Sister organization Boma Training Institute have over the past number of years been training Clergy, Counselors / Psychologists, Lawyers and Human Resource Personnel among other Professionals in professional mediation, majority of who have now been absorbed and accredited by the Judiciary as Mediators among other accreditation bodies.

Majority of the Management Council Members of FWC are certified Professional Mediators who are also Accredited Mediators by the Judiciary and among them are contracted as lead Trainers in Professional Mediation Trainings by Universities, Training Institutions and other organizations.

Family Wellness Centre has also been involved in successfully resolving commercial, religious, community and family disputes and conflicts through mediation among other conflict management mechanisms
